Here is Riverside Business Lawyer Sebastian Gibson’s Top Ten:
1. Your listing hasn’t produced a single interested home buyer.
2. You were the only one at your open house.
3. Your real estate agent isn’t taking your calls.
4. There are for sale signs up at every house on your street.
5. Even the home vandals aren’t interested in your house.
6. The bank’s foreclosure team asks when you will be moving.
7. There are more real estate agents out of work than any other industry.
8. Your real estate agent is working at the local coffee shop making lattes.
9. The home improvement stores in your city are all closing their doors.
10. Your for sale sign was stolen.
Now here is everything (well, almost everything) you need to know in business about environmental, international law, election and campaign law, consumer law, class actions, constitutional, internet, publishing, advertising, media, publicity and privacy rights, employment law, estate planning, wills, trusts, water law, agricultural, insurance law, bad faith, psychologist and psychotherapist defense, education law and child accidents.
You can also find all you need to know (well, mostly) in business about personal injury, car accidents, brain damage, wrongful deaths, business, real estate, landlord-tenant, homeowners association law, construction, patents, trademarks, corporations, entertainment law, advertising, copyrights, food and wine, and hotel and restaurant law and litigation by searching for those subjects and adding the words Riverside business lawyer or Riverside business attorney to your search terms and looking for other articles by Sebastian Gibson.
You can also learn more about any of these business areas of law and how we can assist you as Riverside business attorneys, or as lawyers in any city, by calling the Law Offices of R. Sebastian Gibson at any of the numbers which can be found on our website at http://www.SebastianGibsonLaw.com .
1. Personal Injury, Car Accidents, Brain Damage, Catastrophic Injuries and Wrongful Deaths in Riverside - If you’ve had a Riverside auto, motorcycle, truck, pedestrian, bicycle, bus, train, airplane or car accident of any kind, get the other driver’s information, take camera or cell phone pictures, call the police, get a report, seek medical treatment immediately, call us or another good Riverside personal injury lawyer. Report the accident to your insurance agent, file a report with the DMV and don’t talk to anyone else or give a recorded statement until you talk with an attorney from our office. If you’ve lost a loved on in an accident, call us or another good Riverside personal injury lawyer immediately. Brain damage and catastrophic injury cases as with wrongful death cases require the expertise of a Riverside attorney with experience in these difficult cases. If you want to ensure that you and your family members receive the compensation you deserve, be sure to hire a Riverside personal injury attorney with decades of experience with brain damage, catastrophic injuries and wrongful deaths.
2. Environmental and Toxic Tort Law in Riverside - With multi-billion dollar energy companies spending more money to confuse the public on the threat posed by global warming than on research into alternative forms of energy, it will take all of us to sort fact from fiction and solve the growing problem of global warming. An additional danger to all of us comes from exposure to toxic materials in our daily lives from tainted food, to contaminated ground water, to dangerous viruses in the public and in hospitals to lead and mercury poisoning. If you experience unusual symptoms that a doctor can’t explain, you may have been exposed to a toxic substance and have a toxic tort claim that should be evaluated by us or another qualified Riverside environmental attorney.
3. Riverside International, Shipping and Maritime Law - A Riverside international attorney with years of international legal education and experience such as you’ll find at our Riverside law firm, can provide you with a wealth of practical knowledge and the ability to find answers to your international law questions. It is to your advantage to also have a Riverside international lawyer working in cooperation with foreign counsel in other jurisdictions to ensure that the most cost-effective avenues are pursued to resolve your legal matter. However, many international matters can be resolved with letters between Riverside international lawyers and foreign lawyers, and international mediations and arbitrations can also be utilized. If you have been injured on a ship or an oil rig you have rights under the Jones Act to be compensated for your injuries, medical treatment, past and future wage loss and care.
4. Riverside Election and Campaign Finance Law - If you are considering running for political office or have already done so and are facing campaign finance legal issues, the time to hire a Riverside election attorney with election law knowledge is at the first possible opportunity before you get into hot water that can sink your campaign or put your political career into jeopardy.
5. Riverside Consumer Law and Class Actions - If you have paid for an item but have not received it, been promised an action or service that has not come to fruition or are considering ordering services or signing any type of agreement, the time to hire a Riverside consumer lawyer is immediately in order to avoid being scammed, or defrauded. A Riverside consumer attorney’s letter drafted forcefully but professionally will obtain the desired result, products or services in a good percentage of cases. Whether you ordered gold bars but did not receive them, were told that your car would be paid off when you traded it in on a new one or were promised that a pool would be completed in your back yard, a Riverside consumer attorney can and should be hired for a modest fee to write a letter on your behalf and demand the required action, products or services. If you think you are just one of many who have been scammed or defrauded in some way, you may have a class action.
6. Constitutional, Publishing and Publicity and Privacy Rights, Internet Law, Advertising and Media Law in Riverside - Defamation includes both libel and slander. Anyone in the media or publishing or broadcast world or with a web site is at risk of a lawsuit for claims of defamation or false advertising However, constitutional law questions also arise in civil rights discrimination cases, discrimination in employment and a wide variety of other legal matters. If you have been disenfranchised or your constitutional rights abused in any matter or if you have been accused of abusing the rights of others, contact a Riverside constitutional lawyer as soon as it occurs. If others seek to profit with the use of your name or image you also have a claim for damages.
7. Employment Law in Riverside - It may seem silly to think you should hire a Riverside employment attorney whenever you are considering firing an employee, but it has come to that. However, a consultation with a good Riverside employment law firm can provide you with the advice of how to handle your employee relations both immediately and in the future as you either seek to cut costs or get rid of a problematic employee. If you have been sued or threatened with a suit, or are being scammed by an employee, consult a Riverside employment lawyer immediately.
8. Riverside Estate Planning, Wills and Trusts - The current estate tax in 2008 affects only people who die with an estate in excess of two million dollars. In 2009, that amount will increase to three and a half million dollars and in 2010, the estate tax is repealed. That’s the good news. If, however, the estate tax repeal is not extended by 2011, the estate tax will kick in again. The worse news is that in 2011, if the estate tax repeal is not extended, the estate tax will kick in at one million dollars. The current federal estate tax rate is a whopping 47 percent. That stays the same in 2009. But other current provisions in the tax code change or end in 2010. In light of this, it is more important than ever to hire a Riverside estate planning lawyer to draft your will and evaluate the need for a living trust to avoid probate fees ensure your estate goes to the beneficiaries you want it to go to. If you don’t have a will or trust at death, the state will determine who gets your estate, but it will usually be your spouse and children, of if you have none, your closest relatives.
9. Water, Agricultural and Natural Resource Law in Riverside - It is hoped by American farmers and meat producers that the new Country of Origin Labeling Law taking effect in groceries will cause food shoppers to seek meat and produce from the U.S. over food items from other countries. But it is the water shortage in California that has California farmers faced with dire consequences. In 2008, the California Governor formed a Water Bank to stave off mandatory water rationing, but if California has another dry winter, or more fires that draw upon California’s precious water reserves, or if the state legislature does not address the state’s delta environmental problems and expand the state’s water works, with a bill that has been tied up while the legislators haggled over a budget, rationing across the state could become a reality. If you have a water or agricultural issue, the time to call a Riverside agricultural lawyer with knowledge in this areas is before the issue becomes critical.
10. Insurance Law, Bad Faith, Psychologist, Psychiatrist and Psychotherapist Defense in Riverside - As insurance companies feel the pain of the stock market crash and face the reality of the value of their own investments decreasing, we expect to see insurance companies delaying settlements, and flirting with violations of the insurance bad faith statutes. As the public becomes more and more depressed with the sinking stock market, loss of jobs, reduced income and less enjoyment out of life, we also see the likelihood of greater use of psychiatrists, psychologists and psychotherapists. When claims are made against these professionals without justification, our Riverside law firm stands ready to defend them
11. Riverside Education Law and Child Accidents - A recent court ruling in California has given temporary relief to parents homeschooling their children. However, we still expect further court rulings to make guidelines that will govern when or under what circumstances homeschooling of children will be permitted in California. Children, as any parent knows, can be injured any time, anywhere. What should not happen is any injury to a child that is the result of the negligence of another. To that end, our Riverside personal injury lawyers championed protection for children and convinced at least one court and encouraged other personal injury attorneys to do the same, to uphold a new tort for negligent endangerment of a child.

Homeschool Laws in the U.S.

Homeschool laws vary by state. Some have few to no laws regarding homeschooling, and others are relatively strict. If you’re going to homeschool your kids, it’s absolutely imeprative that you know the laws in your area. If you don’t know the laws, you could end up getting charged with your child’s truancy, which can carry pretty hefty penalties.
You should check with your local Board of Education to find out the laws in your state. They will have the most recent compliance guidelines, and laws can change from time to time. You need to be sure you’re up to date on the most recent laws. Remember, ignorance of the law is no excuse.
There are many resources available on the internet that will give you the basic guidelines of homeschool laws by state. Personally I recommend making sure you get your information directly from your state’s website if that information is available online. It’s better to get it straight from the source, where you know it should be up-to-date.
Don’t forget that many states have record-keeping and testing requirements that you need to comply with, in addition to their registration requirements.
Failure to comply usually just results in a warning, but you could be charged a fine for each child. Some parents (mostly in countries outside the U.S.) have even faced jail time over child neglect charges, so you must keep appropriate records at all times! I wouldn’t risk facing any kind of legal issues simply because you failed to keep adequate records and comply thoroughly with the law.

If you have a water or agricultural issue, the time to call a San Bernardino agricultural lawyer with knowledge in this areas is before the issue becomes critical.
10. Insurance Law, Bad Faith, Psychologist, Psychiatrist and Psychotherapist Defense in San Bernardino - As insurance companies feel the pain of the stock market crash and face the reality of the value of their own investments decreasing, we expect to see insurance companies delaying settlements, and flirting with violations of the insurance bad faith statutes. As the public becomes more and more depressed with the sinking stock market, loss of jobs, reduced income and less enjoyment out of life, we also see the likelihood of greater use of psychiatrists, psychologists and psychotherapists. When claims are made against these professionals without justification, our San Bernardino law firm stands ready to defend them
11. San Bernardino Education Law and Child Accidents - A recent court ruling in California has given temporary relief to parents homeschooling their children. However, we still expect further court rulings to make guidelines that will govern when or under what circumstances homeschooling of children will be permitted in California. Children, as any parent knows, can be injured any time, anywhere. What should not happen is any injury to a child that is the result of the negligence of another. To that end, our San Bernardino personal injury lawyers championed protection for children and convinced at least one court and encouraged other personal injury attorneys to do the same, to uphold a new tort for negligent endangerment of a child.

Basic Home schooling Laws

Ohio is not one of the most stringent in it’s rules and regulations concerning home schooling, however, there are specific guidelines that need to be followed. Unlike some of the other states, it is not required for the home school teacher to have a bachelor’s degree. It is, however, necessary to have either a high school diploma or GED certificate. If the parent, or proposed teacher does not have one of these, the home schooling can be supervised by someone with a degree until the parent completes the qualifications to get their own.
The first step in home schooling in Ohio, is to notify the local school district of your intent, and fill out some paper work, which will outline the requirements of each year of schooling. You will be asked to give the name of the child to be home schooled, the names, addresses, and telephone numbers of the parents, the name of the home school teacher, (if different from the parent), and the educational background of the teacher. This paperwork is required at the beginning of each school year. The person responsible for home schooling the child will need to make a list of the intended subjects for the year, as well as a list of the text books that will be used. The actual subjects and the text books are determined by the home school teacher, however, they are subject to approval by the district involved.
The state requires that the home school teacher includes, in their curriculum, specific subjects, including, language, reading, writing, spelling, math, history of the United States, the state of Ohio, local history and government, science, health, physical education, fine arts, including music, and, first aid and fire safety. A total of 900 hours of actual schooling is required for the school year.
These subjects are taught at the discretion of the individual teacher. For instance, music may be piano lessons, or physical education may be any physical activity that the student and family enjoy such as skiing, biking etc. While local schools do not fund home school students in Ohio, many schools will assist the parent with finding text books and other materials. There are also e-schools available to allow students to take classes online.
Home schooling groups in every community provide support and often field trips and social activities. At the end of the academic year, the student is required to be evaluated by a licensed teacher, an accredited home school evaluator, or someone else jointly approved by the parent and the state. These evaluations can consist of testing or presentation of paperwork and reports showing progress in all of the subjects.
If for any reason any of these requirements are neglected, the state and district may refuse application for home schooling for the next year. Many schools, at the senior level will allow the home school student to test into the senior year, if they wish to graduate from their local school. However, most home school students go on to take their GED certification. By and large, this certification and the subsequent college application testing, which is very similar, makes it fairly easy to transition from home schooling to college level.

Home Schooling: Basic Facts

The term ‘homeschooling’ basically refers to the process in which one or more children of not more than 2 families are instructed by parents or legal guardians, or a member of either household. The laws that define homeschooling vary from State to State. The legal requirements for establishing a homeschool also vary with the State.
For most children, the actual process of learning begins much before school. Many children already know their alphabets, the names of animals, colors and other more complicated stuff before they reach school. This is mostly due to the hard work of a member of the family who has taken the time to teach the child. Homeschooling is just a natural progression from here. Instead of sending their children to a public school, parents make their own curriculum and teach their children in ways that best suit the child. This is homeschooling, in its most simplistic form.
Before you decide to go in for homeschooling, there are certain important matters for consideration. First off, meet with parents of other homeschoolers. Find out the pros and cons of homeschooling. Then ask yourself why you would want to adopt this method. This is a very important aspect, as the success of the program depends on the clarity and sincerity of your purpose.
Next, it is time to consider the expenses of homeschooling. It may cost anywhere between a few hundred dollars to a few thousand every year. More importantly, you are also effectively shutting out any job opportunity for one of the parents. It is only obvious that one parent will have to stay at home full time to manage the homeschool. A home-based business however is a great alternative.
Are you qualified to take on homeschooling for your children? Teaching is a continuation of your own learning process. With the advent of the internet, information is aplenty. There are various books and resources for those interested in homeschooling. Go through the various methods of homeschooling and choose one that is most suited to you. It helps if you know what kind of learning style your child has. Also, find out what your child feels about homeschooling before you start.
Every state has its own laws regarding homeschooling. For instance, in North Carolina, you must first file a ‘Notice of Intent’ to start a home school. In this you have to mention if the school is a ‘Private church’ school or a ‘qualified non-public school’. The persons providing the education are required to have at least a high school diploma. You have to maintain an annual record of the child’s attendance and disease immunization. Every year, the child is required to undergo a standardized test. Each student attending the eleventh grade has to take a nationally standardized test. These are the requirements in North Carolina, but it is enough to give you a good idea of what homeschooling entails.
Homeschooling may seem like a lot of fun and freedom from the outside. However, things are seldom as simple as they seem. Homeschooling is a lot of added responsibility and hard work. But, if successful, it will forge a strong bond of love and respect between parent and child, while providing your child with the best form of education he needs.

Child Safety for Home School: Bicycle Safety for Home Schooling Families

Outdoor activities are great fun and an important addition to any homeschool curriculum. Kids should be encouraged to spend time outside whenever possible to promote physical, emotional, and social health. One of the most popular outdoor activities is bike riding which is fun, exciting, and a pleasurable form of exercise. It is important, however, to properly instruct your homeschooling child on bicycle safety.
First and foremost, the proper equipment should be used. If your child is not an experienced biker, then training wheels are a wonderful resource for teaching balance and promoting confidence on the bike. Helmets, knee and elbow pads, and other protective layers are essential to any safe bike ride. In some places, wearing a helmet is actually the law, so do some research about the laws in the state that you live in.
It is also very important for your homeschooling child to understand that when biking, he or she must be aware that there are other vehicles that use the road. This may seem like on obvious fact, but understanding how to share the road properly will ensure a fun safe bike ride. There are many tips that can help with this practice. Always bike with the traffic, meaning the direction the cars are going. This rule applies whether biking on the road, shoulder, or sidewalk. Try and avoid the busy streets or times of day when the roads are most congested, such as rush hour. When the streets are packed with cars, it limits the vision of the drivers and bikers can be easily overlooked. Drivers expect bikers to obey all traffic signals, signs, and stoplights, just as they are expected to do in their cars. For example, bikers are expected to stop at stop signs and red lights and use appropriate hand gestures as turn signals.
There are also many general rules to follow in order to promote safe bicycle habits. Riding at night is not a good idea because even with headlights, the vision of drivers at this time in limited. Bright clothing and light reflectors should be worn anytime of day while biking as an added measure of safety. While biking, both hands should be kept on the handlebars of the bike. Although it is fun to test your balance or try fun tricks, control can be lost and accidents may happen.
One final word of advice: make bicycling a family affair! The best way to teach your kids about bike safety is by example, helping kids see the importance and reason for the rules that you teach them. They are more than just words from a concerned parent. Biking can be a lot of fun and great exercise, so teach your kids how to best enjoy the experience.

5 Tips for Homeschooling Your Child
June 20, 2008 by Admin
Homeschooling is defined as providing a child’s main education at home. Although this topic has been one of great debate by both critics and supporters, families continue to choose the option of educating their child in the comfort and privacy of their own home. If you are considering this method of learning, keep the following tips in mind:
Consider various teaching options. As a parent, you can often homeschool your child on your own or you may enlist the help of a professional tutor, which is a private teacher who typically teaches one child or a small group of children. In some cases, a child may also participate in independent study programs that are made available through a school.
Make sure the curriculum is approved. If you plan to homeschool your child, you will need to request a curriculum package containing an approved course of study. It’s important that parents make sure the program they use to educate their child is one that’s approved by their state and/or board of education.
Make learning fun. In order for a child to get the most benefit from homeschooling, many believe that visits to the library, museums and other cultural outings can help the student to learn more effectively. This is one of the reasons why public schools often participate in field trips, which allow the children to see a location up close and personal as it relates to their program of study.
Prepare your child for college. Studies have shown that children who learn at home are just as likely to attend a higher learning institution as other students, which means parents who participate in homeschooling will need to prepare their youngster for this change. A homeschooled child who wishes to apply for college must submit a copy of his/her ACT or SAT test scores. As for transcripts, children who gained their education at home may submit records from their supervising high school or correspondence course.
Get everything in writing. As a parent who wishes to homeschool your child, you are required to file the appropriate paperwork with either a local or state education agency. For more information on this topic, you can consult with your county’s board of education or your school’s principal. The name and age of the student must be given, along with lesson plans in some cases. Currently, parents are not required to have a teaching certificate in order to educate their child at home, but it’s important to check with your state’s laws regarding homeschooling as they may vary by state.
One final note: It is very important for home schooled children to be properly socialized with other children. Playing with kids their own age they can learn valuable social skills that will help them become more successful later in life.

Does homeschooling create narrow & bigoted ideas to their children?
May 13, 2008 by Admin
Some critics of homeschooling parents may suggest that they will be passing on narrow and bigoted ideas to their children. I would suggest that you do not have a right to try to prevent this from happening, nor can you prevent it even if you send your children to public schools. I would even go so far as to suggest that this is an issue of a free country vs a police state. What do I mean? Well, in a free country, as long as you obeyed the law, you can believe whatever you like. Your beliefs are none of the government’s business. They have no right to tell you which of your ideas and which of your ideas are bad. Therefore, I do not believe that it is the schools’ “job” to promote the good and stamp out the bad. It is a person’s individual right to believe what they want, and then to try to pass their beliefs along to their children.
What about people who are prejudiced, bigoted, superstitious, etc? Many people would say that people can tell their children anything they want, as long as it is true. This brings up the question of who decides what is true? Most people would agree that there is no one in government or anywhere else whom we would trust to decide that. Therefore, I believe that we can’t give schools the right to tell all children that some ideas are true and others are not. While those who approve of the ideas being taught or promoted in government schools may be glad to send their children there, people who don’t approve of those ideas should have some other choice.
One of the many reasons why growing numbers of people are so passionately opposed to the public schools is that these schools are in fact acting as if someone had explicitly and legally given them the power to promote a specific set of ideas while stamping out another set of beliefs. These people believe that educational bureaucrats, at the state and federal level, largely control what schools say and do. These bureaucrats are increasingly using the schools to promote whatever ideas they happen to think will be good for the children, or the country. Yet, we’ve never formally decided, through any political process, to give the schools such power, nor have we ever agreed on what ideas we would like the schools to promote. In fact, there’s reason to believe that large majorities of people strongly dislike many or most of the ideas that most schools promote today.
Even if everyone agreed that the schools should try to stamp out narrow and bigoted ideas, we’d still have to ask ourselves if this actually works. Clearly it doesn’t. Think about it… Almost everyone in this country, except for a few rich kids, has been going to public schools for several generations now. If schools were as good as they claim to be at stamping out prejudice, then there shouldn’t be any prejudice left. By simply glancing at the news, you can clearly see that there is plenty of prejudice left in this country today. In fact, I would even go so far as to argue that there is less support today than ever before for the tolerance and open-mindedness that the schools supposedly promote. Therefore, I would argue that homeschooling does not create narrow minds. In fact, in most cases it promotes more open mindedness.
